Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to pay the petitioner the amounts, payable towards the encashment of 45 days of earned leaves surrendered by him in the years before his retirement and Employees Retirement Benefit Scheme, as admitted by the respondent in the RTI information dated 05.07.2025 and 20.08.2025, together with 18% interest from the respective due dates.

ORDER

This Writ Petition has been filed seeking a direction to the respondent to pay the amount payable towards encashment of 45 days of Earned

Leave surrendered by the petitioner before his retirement with applicable interest.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner had worked in the Tamil Nadu State Transport Corporation and retired from service on 30.04.2018. On the date of retirement, he was working as a Senior Checking Inspector in the respondent Corporation. However, he was not paid the encashment for 45 days of Earned Leave surrendered prior to his retirement. Though the petitioner made several representations, the same was not considered till date.

4. Considering the facts and circumstances of the case, the respondent is directed to disburse the Earned Leave encashment amount for 45 days surrendered by the petitioner before his retirement, along with applicable interest, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition stands disposed of. No costs.
