The petitioner, who was arrested and remanded to judicial custody on 23.10.2024, for the alleged offence punishable under Section 392 of IPC in Crime No.754 of 2017, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that this petitioner earlier arrested and released on bail and this is the jumped bail, on 04.08.2021 only recently the petitioner was secured. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that already the trial is progressing and material witnesses also examined and witness was not deposed anything incriminating and the petitioner was arrested and he is in judicial custody from 23.10.2024 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that there are seventeen previous cases pending against the petitioner and this petitioner absconded four years after his arrest the trial is pending before the Investigating Officer and he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record 2/4

including the First Information Report.

6. Considering the submissions of the learned counsel on either side, there are seventeen previous cases are pending against the petitioner and the trial stage has reached which is the final stage and this Court is not inclined to grant bail at this point of time to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 16.10.2025 rna To 1.The Judicial Magistrate Court No.II, Tiruppur.
