ORDER

(Made by N.Sathish Kumar, J.) This criminal miscellaneous petition has been filed to condone the absence of the petitioner before the Additional District and Sessions Court, (Fast Track Court), Arani, on 06.10.2025 to comply with the condition as per the order of this Court dated 19.10.2023 passed in Crl.M.P.No.9669 of 2023 in Crl.A.No.720 of 2023.

The petitioner was originally granted bail by this Court on 19.10.2023 in Crl.M.P.No.9669 of 2023 in Crl.A.No.720 of 2023 with certain conditions, one of which is that, the petitioner should appear before the trial Court on the first working day of every month at 10.30 a.m. until the disposal of the appeal.

It is the case of the petitioner that he was complying with the aforesaid condition regularly, but, on 06.10.2025, he was unable to appear before the trial Court due to the baby shower function of his wife and he also suffered dehydration and physical fatigue, due to which, the trial Court

issued non-bailable warrant (NBW).

The learned counsel appearing for the petitioner would submit that non-appearance of the petitioner before the trial Court on 06.10.2025 is neither willful nor deliberate, but, due to the above reasons and therefore, the absence of the petitioner before the trial Court on 06.10.2025 may be condoned.

Considering the reasons stated in the affidavit filed in support of this petition and being satisfied with the same, this criminal miscellaneous petition is ordered as prayed for. The petitioner shall file necessary application before the trial Court to recall NBW. On such petition being filed, the same shall be considered leniently by the trial Court. It is made clear that the petitioner shall abide by the condition imposed by this Court on 19.10.2023 in Crl.M.P.No.9669 of 2023 in Crl.A.No.720 of 2023 till the disposal of the appeal without any further deviation.
