ORDER
The petitioner, who was arrested and remanded to judicial custody on 10.08.2025, for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B) and 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.377 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that on 10.08.2025 at about 09:00 a.m. based on a secret information, the respondent police went near Moonarangadu Water Tank and found that the petitioner along with other accused were in illegal possession of 1.100 kilograms of ganja for the purpose of sales. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 10.08.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that totally there are three accused involved in this case and the petitioner is arrayed as A1; that the petitioner has six previous cases, out of which two cases are of similar nature; and that the investigation of this case is pending.

Considering the facts, nature of allegation, the previous antecedents of the petitioner and taking note of the fact that the investigation of this case is pending, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 16.10.2025 stn 3/4
