PRAYER Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents 2 and 3 to conduct a survey of the petitioner's land comprising S.No.36/5A, 5E, 36/5A , 5E 36/9A total measuring 0.56 1/4 Ares situated at Anaipirandan Village, Thiruvannamalai District along with laying boundary stone and demarcating the boundaries with barbed wire with the assistance of the sixth respondent based on online applications dated 17.02.2025 and 12.08.2025 bearing application Nos.2025/0123/06/ 011684 and 2025/0123/06/018383 within a stipulated time. ORDER
This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents 2 and 3 to act upon the online applications submitted by the petitioner on 17.02.2025 and 12.08.2025 and conduct survey in the subject property and lay the boundary stones.
2. Heard Mr.P.Veeraraghavan, learned counsel for petitioner and Mr.N.Naveen Kumar, learned Government Advocate appearing for respondents 1 to 4 and Mr.L.Baskaran, learned Government Advocate [Crl.side] appearing for respondents 5 and 6.
3. The case of the petitioner is that the petitioner is the owner 2/4
of the subject property by virtue of a sale deed dated 23.03.2021 registered as document No.3740 of 2021. The patta was also issued in favour of the petitioner in Patta No.1588. The petitioner submitted online applications on 17.02.2025 and 12.08.2025 and sought for survey of the property and for demarcation of boundaries and to lay the boundary stones. Since the same was not acted upon, the present writ petition has been filed.
4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the respondents 2 and 3 to act upon the petitioner's online applications dated 17.02.2025 and 12.08.2025 and to conduct survey in the subject property based on the title documents and complete this process within a period of four (4) weeks from the date of receipt of a copy of this Court. If there are any other interested parties, such survey shall be conducted in their presence.
