ORDER

The petitioners, who were arrested and remanded to judicial custody on 21.09.2025, for the offences punishable under Section 123 of BNS and Section 24(1) of the Cigarette and other Tobacco Products Act, 2003 in Crime No.24 of 2025, registered on the file of the respondent police, seek bail.

The case of the prosecution is that on 20.09.2025, while the respondent were on their routine vehicle checkup duty, they found that the petitioners were involved in illegal transportation of banned tobacco products in their vehicles from Bangalore to Tamil Nadu; that 57 packets of Cool lip has been recovered from the petitioner/ A1 and Vimal - 1330 packets, Ganesh - 160 packets, Coolip - 293 packets and Hans - 590 packets have been recovered from petitioner/ A2. Hence, this case. 3.

The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and they are in judicial custody since 21.09.2025. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioners.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and submitted that there are totally four accused involved in this case and the petitioners are arrayed as A2 and A1; that the total quantity of contraband involved in this case is 350 kilograms of banned tobacco products; that the co-accused/ A4 is still absconding; that the petitioner/ Iyyapan is having 3 previous cases and the petitioner/ Raja is having 7 previous cases; and that the investigation of this case is pending. 5.

Considering the submissions made on both sides, gravity of offence, the quantity of contraband involved in this case, the petitioners had bad antecedents and taking note of the fact that the investigation of the case is pending, this Court is not inclined to grant bail to the petitioners. 6.

Accordingly, these criminal original petitions stand dismissed. 29.10.2025 stn K. RAJASEKAR, J.
