ORDER
The petitioner, who was arrested and remanded to judicial custody on 1/4
20.09.2025, for the alleged offence punishable under Sections 126(2), 296(b), 309(6), 311, 125(b), 324(2) and 351(3) of BNS in Crime No.107 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the defacto complainant is running a vegetable shop at Metupalayam. While so, on 19.04.2025 the petitioner went to defacto complainant's shop and demanded sum of Rs.300/- thereafter he robbed sum of Rs.300/- from the defacto complainant. This petitioner has approached this Court in Crl.O.P.No.14819 of 2025 and withdrawn the same. Thereafter, the petitioner has filed the bail petition before the Sessions Court in Crl.M.P.No.4175 of 2025, which was allowed on 14.05.2025 and he was granted bail with condition that he shall appear before the respondent police regularly until further orders. However, he has not complied a condition. Hence, his bail was cancelled by the Sessions Court in Crl.M.P.No.5435 of 2025 dated 23.07.2025, without furnishing all the copies of above order, this petitioner based on the earlier dismissal order as early as on 28.04.2025, this petition is filed.

The learned counsel appearing for petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution, and he has been falsely implicated in this case and the petitioner herein due to the illhealth he was not able to comply the earlier bail conditions. Hence the Sessions court has cancelled the bail in Crl.M.P.No.4175 of 2025 dated 2/4
14.05.2025. Hence, he prays for grant of bail.
4. The learned Government Advocate (Crl. Side) appearing for respondent would submit the petitioner having 9 previous cases and having bad antecedents and he was granted bail on 23.07.2025 and since he had not complied the bail conditions bail is cancelled and he was arrested on 20.09.2025 and the investigation is still pending. Hence, he opposed to grant bail to the petitioner.
5. Considering the above facts, earlier bail application granted to the petitioner has been cancelled for violation of the bail conditions, and no proper reason has been produced before this Court, and this Court is not inclined to grant bail to the petitioner.
