PRAYER: Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of Writ of Mandamus, directing the respondents to allow the petitioner to run the firecracker shop in S.F.No.6/2A at Valangaiman Village and Taluk, Thiruvarur District till the license period, i.e, upto 31.03.2026. ORDER

Ms.P.Aishwarya, learned Government Advocate takes notice on behalf of the respondents. With the consent of the learned counsel appearing for the parties, this writ petition is taken up for final disposal at the stage of admission itself.

The learned counsel appearing for the petitioner submits that the petitioner is running a retail firecracker shop, for which, he is having a license issued by the 2nd respondent dated 13.10.2018 and, the same was periodically extended for the period from 01.04.2023 to 31.03.2026. He would submit that till date, no adverse order was passed as against the petitioner however, frequently, the Official respondents are interfering with the petitioner's business thereby, the present Writ Petition is filed for a direction to the respondents, not to interfere with the petitioner's business till 31.03.2026.

3. The learned Government Pleader appearing for the respondents submit that there is no restraint order passed as against the petitioner and the petitioner's license period is valid upto 31.03.2026.

4. If at all any violations of safety norms, the respondents shall make an objection for running the shop stating that the present place is not suitable. If any such objection is made by the respondents, the petitioners shall file an affidavit undertaking to vacate the premises and suggesting suitable place for running the shop for the next year.

In view of the same, this Writ Petition is disposed of, directing the respondents, not to interfere with the petitioner's business and allow the petitioner to run the firecracker shop in S.F.No.6/2A at Valangaiman Village and Taluk, Thiruvarur District till the license period, i.e., upto 31.03.2026.
