This writ petition has been filed for direction directing the respondents to settle the petitioner's retirement benefits as per VII Central Pay Commission with all consequential arrears of salary and other retirement benefits with eligible interest thereon from 30.06.2017 i.e. for a total sum of Rs.23,16,838/- (Rupees twenty three lakhs sixteen thousand eight hundred thirty eight only).
2. Heard the learned counsel for both sides and perused the materials available on record.

3. It is seen that the petitioner already filed a Writ Petition in W.P.No.1847 of 2018 before this Court seeking retirement benefits without reference to the order dated 27.05.2011.

On perusal of the order dated 27.05.2011, it is revealed that it was passed with regard to reviewing all promotion/upgradation/replacement scale/re-designation etc., in respect of the petitioner and others. It was challenged and now it is pending before the Division Bench of this Court. Therefore, this Court already directed the Registry to club the writ petition, which was already filed by the petitioner in W.P.No.1847 of 2018, along with W.A.No.303 of 2022 before the Hon'ble Division Bench of this Court.
5. Now, once again the petitioner filed this Writ Petition seeking very same relief with slight modification that, as per the VII Central Pay Commission, both the prayers are one and the same. Therefore, this writ petition itself cannot be entertained since another writ petition has already been filed seeking, the very same prayer and it is pending. Hence, this Writ Petition is devoid of merits and is liable to be dismissed. 3/5
