ORDER
The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 303(2) of the BNS, 2023 in Crime No. 134 of 2025, seek anticipatory bail. 2.The allegations against the petitioners are that they, in collusion with other other accused, were involved in the illegal quarrying of gravel, sand and stones from Government poromboke land in Karkoodalpatti Village. Upon seeing the officials, they fled the scene, abandoning a JCB bearing registration No.TN-28-CZ-4753 and a Tipper Lorry bearing Registration No.TN-28-CX3989.
3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that they are ready to abide by any conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioners.
4. The learned Government Advocate (Criminal side) for the respondent police, submitted that the investigation in this case is pending, hence, he opposed to grant anticipatory bail to the petitioners.
5. Considering the nature of allegations, the submissions made by learned counsels on either side, and considering the fact that the petitioners are not only illegally quarried gravel sand but also caused damage to the ecology, therefore, this Court is not inclined to grant anticipatory bail to the petitioners.
