ORDER

This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. The allegation in this case is that on 01.05.2013, the accused protested against the Government without due permission. A case was registered in Cr.No.169 of 2013 for the alleged offence under Section 3 of Prevention Of Damage To Public Property Act, 1984. The accused are said to have cut the trees on the road margin and blocked the road on account of political protest. It is seen that the PRC is pending because the police is facing difficulty to execute the warrant as the names of the accused and the names of their respective fathers are reportedly incorrect. Be that as it may, the case is pending from the year 2013.

3. Considering the nature of allegations, it can be seen that the allegations concern exercising the democratic right to protest. Even if the accused names are corrected and they are properly brought to face the trial, it will impinge upon the right to a speedy trial of the accused. No useful purpose will be served by continuing the case.

4. Accordingly, the case in P.R.C.No.19 of 2023 of Judicial Magistrate Court, Pappireddipatti Taluk, Dharmapuri, stands quashed. This Suo Motu Transfer Case is disposed of.

14.10.2025 sha electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
