ORDER
The writ petition is filed challenging the impugned order of rejection of the 3rd respondent dated Nil on the Legal Heir Application of the petitioners bearing Application No. TN- 7202408052283 dated 5.08.2024 submitted through E-Seva Online and consequently direct the respondents to consider the first petitioners representation dated 31.05.2025 and issue Legal Heir certificate to the petitioners within a time frame as stipulated by this court

The case of the petitioners is that the first petitioner's husband, S.Michael born in Vellore in the year 1952 and the first petitioner married Michael in the year 1983 and they were blessed with a son on 25.07.1994 who is second petitioner herein. The first petitioner's husband died on 18.06.2022. Thereafter, the second petitioner made an application for issuance of legal heirship on 05.08.2024 and the same was rejected on the ground that the first petitioner's husband permanent address is Puducherry and petitioners are resident of Puducherry. The first petitioner again made a representation on 31.05.2025 on the file of the first respondent. The first respondent forwarded the same to Tahsildar, Ranipet, the third respondent herein vide proceedings dated 20.06.2025. Thereafter, the Tahsildar, Ranipet, forwarded the same to the Revenue Divisional Officer, the second respondent, for conducting enquiry. However, no orders have been passed so far. Hence, the petitioner has filed the present writ petition is filed.
3. Learned counsel for the petitioners would submit that as against the rejection order passed by the third respondent, the second petitioner preferred an
appeal before the first respondent.

Learned counsel for the petitioners would submit that earlier the second petitioner's application was rejected solely on the ground that first petitioner's husband is resident of Puducherry, however her husband was born in Ranipet and for occupational purpose, the first petitioner and her husband moved to Puducherry. In puducherry, the second petitioner was born. Due to first petitioner husband's illness, they moved to Ranipet and he died there.

In view of the above, considering the facts and circumstances of the case, this Court directs the petitioners to produce all the necessary certificates including marriage certificate before the third respondent, within a period of two weeks from the date of receipt of a copy of this order. The third respondent on receipt of the same, is directed to entertain the application dated 31.05.2025, which was forwarded by the first respondent vide proceedings dated 20.06.2025 and conduct an enquiry and peruse the entire records produced by the petitioners, without referring to earlier application and rejection order and pass
orders, on merits and in accordance with law, within a period of four weeks thereafter.
