Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Certiorarified Mandamus, calling for records pertaining to the issue of the impugned order dated 13.05.2024 vide proceedings Na.Ka. 668/ 2024/ 2A on the file of the 2nd respondent and to quash the same and to direct the 1st respondent to issue patta to the petitioner in respect of the lands in Survey Nos contained in the report of the 1st respondent dated 31.01.2024 For Petitioner :

O R D E R

This writ petition has been filed challenging the impugned proceedings of the second respondent dated 13.05.2024 and for consequential direction to the first respondent to issue patta in the name of the petitioner with respect to the subject property.

2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.

3. The petitioner had earlier approached this Court and filed a writ petition in W.P.No.21658 of 2012 challenging the proceedings of the 2/6

District Collector dated 29.07.2011. The said writ petition was disposed of by an order dated 05.07.2022 and relevant portion of the order is extracted hereunder:

"7. In view of the limited relief sought for in by the petitioner, this Court, without going into the merits of the case, directs the petitioner to make a fresh representation to the official respondents after disposal of the suit in O.S.No.449 of 2004 pending before the Chengalpattu District Fast track Court. If such representation is being made, the jurisdictional Tahsildar shall consider the same and pass appropriate orders on merits after affording opportunity to the petitioner as well as the counter parties within a period of twelve weeks from the date of receipt of the representation."

4. Pursuant to the above order, the petitioner submitted an application seeking for patta. The said application came to be rejected by the second respondent mainly on the ground that a suit in O.S.No.449 of 2004 is pending before the concerned civil Court and therefore, the application submitted by the petitioner cannot be considered.

5. It is under these circumstances, the present writ petition came to be filed before this Court.

6. The learned counsel for the petitioner submitted that already the petitioner is taking steps to withdraw the suit filed in O.S.No.449 of 3/6

2004 which is pending before the Chengalpattu District Fast track Court. The learned counsel submitted that after the withdrawal of the suit, the petitioner will submit a fresh application before the second respondent and the same can be considered on its own merits and in accordance with law.

In the light of the above submission made by the learned counsel for the petitioner, it is left open to the petitioner to withdraw the pending suit in O.S.No.449 of 2004 and thereafter, make a fresh representation to the second respondent which will be considered by the second respondent on its own merits and in accordance with law, as expeditiously as possible.

The Writ Petition is disposed of in the above terms. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
