Prayer:Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 2nd respondent or under his supervision to conduct independent, free and fair enquiry on petitioner's application to record his name as cultivating tenant in the Adangal for land in T.S. No K / 7 / 20/ 1 with an extent of H-01- 93-A Ca. 00 situated at No. 29, Oduthurai Revenue Village in the place of his paternal aunt Mrs Rajalakshmi by considering his representation / applications dated 20.04.2015 and proceedings in Case, No. OP. 10/ 20 / 215 / Adangal and reminder dated 01.03.2024 within a time frame fixed by this Court.

This Writ Petition has been filed seeking a direction to the 2nd respondent or under his supervision to conduct independent, free and fair enquiry on petitioner's application to record his name as cultivating tenant in the Adangal for land in T.S. No K / 7 / 20/ 1 with an extent of H-01- 93-A Ca. 00 situated at No. 29, Oduthurai Revenue Village in the place of his paternal aunt Mrs Rajalakshmi by considering his representation / 2/6
applications dated 20.04.2015 and proceedings in Case, No. OP. 10/ 20 / 215 / Adangal and reminder dated 01.03.2024 within a time frame fixed by this Court.
2.The learned counsel for the petitioner would submit that the petitioner's aunt namely Rajalakshmi was the cultivating tenant in respect of the aforesaid property.Further he would submit that based on the authorisation given by his aunt, the petitioner submitted an application on 20.04.2015 to the respondents to enter the name of the petitioner in Adangal in the place of his aunt Rajalakshmi. Though the petitioner was called for enquiry during 2015, no order has been passed till date. In the meantime, the petitioner's aunt executed will in favour of the petitioenr on 27.01.2016 and thereafter she passed away on 24.06.2020. As the application submitted by the petitioner on 20.04.2015 is kept pending till date, the present writ petition has been filed.
3. The learned Additional Government Pleader appearing for the respondents would submit that the 3rd respondent will consider and pass orders on the application of the petitioner, within the stipulated time fixed 3/6
by this Court.
4. Heard both sides. Perused the records.
5. Considering the facts and circumstances of the case and having regard to the submissions made, without going into the merits of the case, this Court directs the 3rd respondent to pass orders on the application of the petitioner dated 20.04.2015, on merits and in accordance with law, after giving notice to the petitioner and after affording an opportunity of hearing to the petitioner and the persons concerned, within a period of eight weeks from the date of receipt of a copy of this order.
6. With the aforesaid directions, this writ petition is disposed of. No costs.
