Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 3 to 6 to survey and demarcate the petitioner's property bearing New Survey No.9/11 (Old Survey No.389/22 and Plot No.7) located at Tambaram Village, Tambaram Taluk, Chengalpattu District and consequently direct the respondents 3 to 6 to issue patta for the above mentioned property in favour of the petitioner within a time limit fixed by this Court. ORDER
This Writ Petition has been filed seeking a direction to respondents 3 to 6 to survey and demarcate the petitioner's property bearing 2/6
New Survey No.9/11 (Old Survey No.389/22 and Plot No.7) located at Tambaram Village, Tambaram Taluk, Chengalpattu District and consequently to direct the respondents 3 to 6 to issue patta for the above mentioned property in favour of the petitioner within a time limit fixed by this Court.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner has a land comprised in New Survey No.9/11 (Old Survey No.389/22 and Plot No.7) located at Tambaram Village, Tambaram Taluk, Chengalpattu District. In order to survey the said land, the petitioner submitted an application before the respondents. So far the respondents did not take any step to survey and demarcate the aforementioned land belongs to the petitioner. Hence, this writ petition.
4. In view of the above, the fourth respondent is directed to survey the petitioner's aforesaid land based on the title deed produced by him, after 3/6
issuance of notice to the adjacent land owners and counter parties, if any, and to serve the survey report to the petitioner within a period of six weeks from the date of receipt of copy of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject land, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police protection to the surveyor.

Further, the fourth respondent is directed to consider the representation of the petitioner dated 04.01.2024 in respect of of patta and, after issuance of notice to the petitioner and counter parties, if there are, and giving them opportunity of personal hearing, to pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of this order.
6. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
