PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing respondents 1 and 2 herein to consider the application dated 28.08.2024 for consent/renewal and for issuance of NOC for re-commencement of the distillery operations of the petitioner company in accordance with law.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) As against the petitioner's complaint that the application seeking consent to operate has remained pending for long time, learned counsel for respondent Nos.1 and 2, on advance copy, would inform the court that presently the matter is pending consideration before the authority.

2. Learned counsel for respondent Nos.1 and 2 further submits that one of the reasons for the matter having remained pending was that there is a serious allegation of corruption levelled against the director of the petitioner company, wherein the matter

travelled up to the court with filing of charge sheet. All these issues are under consideration at the appropriate level and decision would be taken at the earliest possible.

3. Having considered the submissions, at this stage, we are not inclined to keep the matter pending, but dispose it of with a direction to the respondent authorities to take a decision one way or the other, preferably within three months. We hasten to add that we have not expressed any opinion on the merits of the petitioner's claim.

Writ petition is disposed of accordingly. There shall be no order as to costs.
