PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus, to direct the second and third respondents to release the petitioner earned leave accumulation (100 days) along with 12% interest, which remains unlawfully withheld after the retirement of the petitioner, within the stipulated time. .

ORDER

This writ petition has been filed for a direction, directing the respondents 2 and 3 to release the petitioner's earned leave accumulation with applicable interest.

2. The petitioner was appointed as Assistant Teacher and joined duty on 03.10.2007. After implementation of 6th Pay Commission, her salary was fixed at Rs.14630/- in the pay band of Rs.9300-34800 with Grade pay of Rs.4400/- with effect from 03.10.2007. After completion of her B.Ed., she was granted two increments with effect from 03.10.2007. Her salary was increased from Rs.4400 to Rs.4600 and once again re-fixed. The petitioner retired from service on 2/4

30.07.2022. She was also settled with terminal benefits under the CPS on 21.08.2023. Even then the petitioner was not paid earned leave encashment for 100 days. Therefore, the petitioner submitted a representation.

3. In view of the above, the second and third respondents are directed to consider the request made by the petitioner seeking earned leave accumulation for 100 days on merits and in accordance of law. If the petitioner is entitled for the said amount, disburse the same with applicable interest at the rate of 6 % per annum, within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above directions, the writ petition stands disposed of. No costs. 03.11.2025 Speaking (or) Non Speaking Order mrn 3/4
