ORDER

This Writ Petition has been filed for a direction directing the respondent to pay the difference in Gratuity amount of Rs.47,257/- as per the 13 th wage 1/4

settlement dated 04.01.2018 with interest at the rate of 10%.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner joined the service of the respondent corporation as a Conductor on 17.05.1989 and retired on 31.12.2017 as a Special Grade Conductor. Subsequently, the 13th Wage Settlement was entered into between the Management and the Trade Unions on 04.01.2018, pursuant to which the wages and pension were also revised with effect from 01.09.2016. Since the petitioner had retired on 31.12.2017, he is entitled to the difference in Gratuity amount as per the 13 th Wage Settlement. Accordingly, the petitioner submitted a representation seeking the differential amount of Gratuity as per the 13th wage settlement dated 04.01.2018. However, the said representation has not been considered so far.

In view of the above, the respondent is directed to pay the applicable differential amount of Gratuity to the petitioner, in accordance with the 13 th Wage Settlement dated 04.01.2018, together with interest at the rate of 6% per annum, within a period of twelve weeks from the date of receipt of a copy of this order.

5.With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
