ORDER

This Writ Petition has been filed for a direction directing the respondents to revise the petitioner's wages with effect from 01.09.2019 based on the 14th wage settlement dated 24.08.2022 and pay him the difference in Leave Salary, Gratuity and Arrears of pension from 01.06.2022 to 28.02.2023 along with the interest at the rate of 12 percent per annum from the date of entitlement to till the date of actual disbursement within a time limit to be stipulated by this Honourable Court.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3.The petitioner worked as a Selection Grade Conductor in the respondent Corporation and retired from service on 31.05.2022. However, the respondent Corporation settled his retirement benefits only on 25.06.2023. In the meantime, the 14th Wage Settlement under Section 12(3) of the Industrial Disputes Act was entered into between the Management and the Trade Unions and was signed on 2/6

24.08.2022. As per the terms of the settlement, the Management agreed to revise the wages of employees who were in service as on 01.09.2019, by enhancing their pay by 5% over the previous wage structure. Since the petitioner was in service until 31.05.2022, he is entitled to receive arrears and all consequential benefits arising from the 14th Wage Settlement. Accordingly, the petitioner submitted a representation to the respondents requesting revision of his wages and corresponding retirement benefits in terms of the 14th wage settlement. However, his representation has not been considered till date.

In view of the above, the respondents are directed to revise the wages of the petitioner with effect from 01.09.2019 in terms of the 14th Wage Settlement dated 24.08.2022 and to disburse the differential amount towards Leave Salary, Gratuity and Arrears of pension from 01.06.2022 to 28.02.2023, together with interest at the rate of 6% per annum from the date of entitlement till the date of actual disbursement, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
