Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the third respondent herein, to register the Sale Deed presented by the petitioner herein in respect of the land measuring 35 cents (0.14.0 Ares) in Survey No.18, Vazhuthareddy Village, Villupuram Taluk, as per the 4th respondent's proceedings in O.Mu.A6/4919/2022 signed on 30.11.2022, Letter from the fourth respondent to the third respondent in O.Mu.(A6)/421/2023 dated 15.03.2023, and as per judgement and decree dated 28.04.2025 passed by the Additional District Court, Villupuram. ORDER

The relief sought for in this writ petition is to direct the third respondent herein, to register the Sale Deed presented by the petitioner herein in respect of the land measuring 35 cents (0.14.0 Ares) in Survey No.18, Vazhuthareddy Village, Villupuram Taluk, as per the 4th respondent's proceedings in O.Mu.A6/4919/2022 signed on 30.11.2022, Letter from the fourth respondent to the third respondent in 2/6

O.Mu.(A6)/421/2023 dated 15.03.2023, and as per judgement and decree dated 28.04.2025 passed by the Additional District Court, Villupuram.

2. Mr.U.Baranidharan, learned Special Government Pleader takes notice on behalf of the respondents 1 to 4. By consent of both the parties, this writ petition is taken up for final disposal at the stage of admission itself.

Learned counsel for the petitioner submitted that the petitioner has purchased the land measuring 35 cents in S.No.18, Vazhuthareddy Village, Villupuram Taluk from the respondents 5 & 6, under the Sale Deed dated 28.04.2017 and presented the same before the third respondent for registration. However, the same was refused to register citing the reason that the aforesaid property is a "Myana Poramboke" and further a civil suit in O.S.No.99 of 2011 on the file of Principal District Court, Villupuram, is pending. Hence, the petitioner has come forward with the present writ petition.

4. Learned Special Government Pleader appearing for the respondents 1 to 4 would submit that the petitioner has not presented any sale deed for registration, as on date. In the event, the petitioner files any sale deed for registration, the same will be considered by the respondents on merits and in accordance with law.

5. Heard the learned counsel on either side and perused the materials available on record.

6. In view of the above facts and circumstances of the case, this Court issues following directions:

(i) The petitioner is directed to present the sale deed dated 28.04.2017 for registration, before the third respondent; (ii) On such receipt, the third respondent is directed to take the same on record for the purpose of registration and register the sale deed on merits and in accordance with law.

With the above directions, this writ petition stands disposed of. No costs.
