Prayer :- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 4 and 5th respondents to dispose of the petitioner's representation dated 03.03.2025 to carryout survey and sub division to the public pathway and update the 1/5
pathway in the FMB sketch which is existing in survey no.12/1 situated at Itlapatti Village, Harur Taluk, Dharmapuri District within a stipulated time as fixed by this Honble High Court.
For Petitioner : Mr.Krishnasamy Chinnasamy For Respondents 1 to 5 : Mr.R.P.Murugan Raja Government Advocate Order This Writ Petition has been filed seeking for a direction to the respondents 4 and 5 to carryout survey and sub-division of the public pathway and update the pathway in the FMB sketch, which is existing in the property morefully described in the prayer to this Writ Petition based on the petitioner's representation dated 03.03.2025 within a time frame to be fixed by this Court.
2. The petitioner claims that usage of the aforesaid public pathway by the petitioner has been obstructed by certain encroachers. In such circumstances, the petitioner has given a representation to the respondents 4 and 5 on 03.03.2025 to enable the petitioner to use the public pathway without any obstructions. Since the said representation has not been considered till date, the petitioner has filed this Writ petition. 2/5
3. Till date, counter affidavit has not been filed by the respondents.
4. No prejudice would be caused to the respondents, if the petitioner's representation is considered on merits and in accordance with law within a time frame to be fixed by this Court after hearing the objections of all necessary parties. This Court is not expressing any opinion on the merits of the representation made by the petitioner.
5. For the foregoing reasons, this Court directs the respondents 4 and 5 to pass final orders on merits and in accordance with law on the petitioner's representation dated 03.03.2025 seeking to carryout survey and sub-division of the public pathway and update the pathway in the FMB Sketch, which is existing in the property morefully described in the prayer to this Writ Petition after hearing objections of all necessary parties within a period of twelve weeks from the date of receipt of a copy of this order. 3/5
6. With the aforesaid direction, this Writ Petition is disposed of. No costs.
