Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the first respondent to process the petitioner's application dated 12.11.2024 filed under Section 28A of the Land Acquisition Act, 1894, seeking for redetermination of compensation in respect of the petitioner's acquired lands, in accordance with the Judgment dated 14.08.2024 passed by the Hon'ble Special SubCourt for L.A.O.P. ORDER
The relief sought for in this writ petition is to direct first respondent to process the petitioner's application dated 12.11.2024 filed under Section 28A of the Land Acquisition Act, 1894, seeking for redetermination of compensation in respect of the petitioner's acquired lands, in accordance with the Judgment dated 14.08.2024 passed by the 2/7

2. P.Sathish, learned Additional Government Pleader takes notice on behalf of respondents 1 to 3. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.

The case of the petitioner is that the petitioner is the owner of the land bearing S.Nos.53/1D1B, 53/1E1C, 53/2B22B, 53/2C1B situated at No.13, Vellanur Village, Plot No.504BB, Arch Antony Nagar Extension-2 (Block No.6) measuring to an extent of 2400 sq.ft., (0.02.5 hectares). This being so, the aforesaid 0.02.5 hectares were acquired by the Government for the purpose of Outer Ring Road scheme (Unit-V) by way of Section 4(1) Notification under the Land Acquisition Act, 1894, dated 21.03.2006. Thereafter, the third respondent passed an award, fixing the compensation at the rate of Rs.1000/- per cent, for which the petitioner made her objection. Later, the petitioner received the compensation of Rs.10,090/- for the acquired land on 30.01.2023. 3/7
3.1. Under the aforesaid circumstances, the petitioner came to know that landowners from the same village, whose lands were acquired under the same notification had approached the Court under Section 18 of the Land Acquisition Act, 1984 and by judgment dated 14.08.2024 in L.A.O.P.No.42 of 2023, the Sub-Court, Tiruvallur enhanced the compensation from Rs.1000/- to Rs.50,000/- per cent with all statutory benefits. Since the petitioner was not aware of the procedure to seek enhanced compensation under Section 18 of the Land Acquisition Act, 1894, she filed an application under Section 28A of the Land Acquisition Act, 1894 on 12.11.2024 before the first respondent for redetermination of compensation based on the said award. However, no order was passed. In this regard, the petitioner has also sent a representation dated 21.07.2025, which was also not considered, as on date. Hence, the petitioner has come forward with the present writ petition.
4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this 4/7
Court issues direction to the first respondent to consider the petitioner's application dated 12.11.2024.
5. Learned Additional Government Pleader appearing for the respondents 1 to 3 submitted that the petitioner's petitioner's application dated 12.11.2024 would be considered and appropriate orders passed, within a time frame that may be fixed by this Court.
6. Heard the learned counsel on either side and perused the materials available on record.

Considering the limited relief sought for by the learned counsel for the petitioner, this Court without going into the merits of the case, directs the first respondent to consider the petitioner's application dated 12.11.2024 and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

With the aforesaid direction, this writ petition is disposed of. No costs.
