Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the respondents to upgrade the posts held by the petitioners to the categories of Executive Engineer and Superintending Engineer from the dates on which the petitioners' juniors in Public Works Department were promoted, earlier to the petitioners, as Executive Engineer / Superintending Engineer as the case may by designating the petitioners as Special Executive Engineers, or / and Special Superintending Engineers as the case may be from the respective dates on which their respective juniors were promoted as Executive Engineers, or/and Superintending engineer and fix their pay in the pay scales applicable the respective categories viz., Executive Engineer and Superintending Engineer from the said dates as per the orders issued in Para-9(D) of G.O.Ms.No.158 Public Works (D2) Department dated 01.11.2021 and to pay the arrears of pay with appropriate interest, from the respective dates of due to the dates of 2/6

This writ petition has been filed for direction to the respondents to upgrade the posts held by the petitioners to the categories of Executive Engineer and Superintending Engineer from the dates on which the petitioners' juniors in Public Works Department were promoted, earlier to the petitioners, as Executive Engineer / Superintending Engineer as the case may by designating the petitioners as Special Executive Engineers, or / and Special Superintending Engineers as the case may be from the respective dates on which their respective juniors were promoted as Executive Engineers, or/and Superintending engineer and fix their pay in the pay scales applicable the respective categories viz., Executive Engineer and Superintending Engineer from the said dates as per the orders issued in Para-9(D) of G.O.Ms.No.158 Public Works (D2) Department dated 01.11.2021 and to pay the arrears 3/6

Heard, the learned counsel appearing on either side. 3.

Without expressing any opinion on merits of the writ petition, the first respondent is directed to consider the case of the petitioner as prayed in this writ petition and to pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of this order.

With the above direction, this writ petition is disposed of. There shall be no order as to costs.
