ORDER

This petition has been filed with the following prayer: "To direct the second respondent to conduct a enquiry, based on the petitioner's online complaint dated 15.09.2025 under Section 151 of the Police Standing Order into the Kattapanchayat, no torture on the above for the illegal activities committed by them and dispossessing the petitioner from the lawful possession until final disposal of the civil suit in O.S.No.53 of 2024, on the file of the District Munsif Court at Cheyyur".

2.The case of the petitioner is that her family owns a land in Nergunapattu Village, Cheyyur Taluk, measuring about 137 acres. The fifth and sixth respondents, by fabrication of documents and impersonation, had grabbed the property belonging to her. The further allegation is that the petitioner had given

3/6 a complaint on 15.09.2025 to the second respondent and the second respondent, without conducting a proper enquiry under PSO 151 is conducting Katta Panchayat and directed the petitioner to get out of the property. Hence, the present petition has been filed before this Court. 3.The learned counsel for the petitioner submitted that the petitioner is the owner of the property, whereas, the fifth and sixth respondents, based on the fabricated documents, have taken possession of the property and the third respondent police, instead of enquiring into the matter, are conducting Katta Panchayat.

4.Per contra, the learned Government Advocate (Crl.Side) appearing for the respondents 1 to 3 would submit that there is a civil dispute pending between the petitioner and respondents 5 and 6. The respondents 5 and 6 claim that the petitioner had sold the property to them and the petitioner is interfering with the possession; they have filed a suit in OS No.53 of 2024 before the District Munsif Court at Cheyyar and the suit is pending; based on the complaint given by the petitioner, an enquiry was conducted in CSR No.598 of

4/6 2025; a counter complaint has been given by the 5 th respondent contending that the petitioner is interfering with their possession after selling the property to them in the year 1991; at the same time, petitioner has also preferred a complaint before the District Revenue Officer, Chengalpet and the District Revenue Officer, by an order dated 19.07.2025, had directed the petitioner to approach the Civil Court. He would further submit that now, the dispute between the parties is pending before the Civil Court; the enquiry in CSR Nos.598 & 599 of 2025 has been closed directing the parties to approach the civil forum; the respondent police are not interfering with in the civil dispute and the allegation of Katta Panchayat is false; Mr.N.S.Nagalingam, third respondent is present before this Court and he has not interfered with the civil dispute.

5.Recording the same, this petition stands closed granting liberty to the petitioner to approach the appropriate civil forum. No costs. Consequently, connected miscellaneous petition is closed.
