ORDER
This application has been filed for appointment of an Advocate Commissioner to seize the equipments from the premises of the respondent and if required, with police protection. 2.
The case of the applicant is that they had agreed to provide the equipments to the respondent and accordingly, entered into an agreement dated 10.10.2023 with the respondent. Accordingly, the equipments were handed over to the respondent and the same was installed in the premises of the respondent. 3.
The grievance of the applicant is that the respondent had de-installed the equipments provided by the applicant without any prior intimation and had also installed from another 3rd party entity. Thereafter, various discussions / meetings were held but the parties failed to reach any settlement.

It is under these circumstances, the present application has been filed for appointment of an Advocate Commissioner to seize the equipments.

Notice was ordered to the respondent and the same has been served. Accordingly, on 05.01.2026, the following order came to be passed by this Court:- When the matter was taken up for hearing today, the learned counsel for the applicant submitted that the private notice that was sent to the respondent has been served. Affidavit of service has also been filed.
2.Registry is directed to print the name of the respondent in the cause list and post this application for hearing on 07.01.2026. 6.
Pursuant to the above order, the name of the respondent has been printed in the cause list and there is no appearance either in person or through counsel.

Heard the learned counsel for the applicant and carefully perused the materials available on record.

It is quite evident that the respondent has received the equipments from the applicant and the respondent is neither using the equipments nor returning back the equipments to the applicant and as a result, the applicant apprehends that there is an imminent risk of damage to the equipments. The applicant has also issued the
trigger notice under Section 21 of the Act on 14.08.2025. 9.
In view of the above, Mr.D.Teddy Joshua, is appointed as the receiver and the receiver is permitted to seize the equipments from the respondent or wherever it is found and by breaking open the premises, if required with police assistance. 10.
