ORDER

The second respondent/victim had lodged a complaint to the first respondent police, based on which, a case in crime No.242 of 2024 was registered.

2.Since the investigation was not proceeding, he filed a transfer of investigation petition in Crl.O.P.No.9460 of 2025, this Court by order dated 01.04.2025, finding already case transferred to the file of Vigilance and Anti Corruption, Puducherry and further sanction to be obtained against the public servant, this Court directed the Superintendent of Police, (V&AC) Puducherry to monitor the investigation, completed the investigation within a stipulated time. The Vigilance and Anti Corruption filed a petition in Crl.MP.No.14837 of 2025 sought extension of time to complete the investigation and this Court by order dated 04.08.2025, considering the request of the Investigating Agency, granted another eight weeks time to complete the investigation. Now, in this background, the present petition filed.

3.The learned Public Prosecutor, Puducherry (V and AC) submitted that in this case, there are several accused, and the prime accused is still absconding, yesterday, prime accused filed an application for Anticipatory bail and it was dismissed. It is a job racketing and there are several victims, who

have paid to the prime accused and investigation is at the crucial stage. The Mobile phones collected sent to forensic examination and forensic report yet to be received, the absconding accused is yet to be apprehended and hence seeks further period of three months time to complete the investigation and file a final report.

4.Counsel for the second respondent submitted that though, earlier it was reported that investigation completed, except for obtaining the sanction and the case is complete in all forms, but now prosecution comes up with a new ground that FSL report is yet to be received, and prime accused is yet to be arrested. In any event investigation can be completed without further delay. The petitioner is also a victim.

5.Considering the submission and the stage of the investigation, in this case prime accused absconding, yesterday, Anticipatory bail petition dismissed and FSL report is yet to be received, hence, this Court directs the Inspector Vigilance and Anti Corruption to complete the investigation and file a final report without further delay preferably within a period of three months from the date of receipt of a copy of the FSL report.
