This application has been filed by the applicant to condone the delay of 94 days in filing the written statement in C.S.No.95 of 2025. 2.According to the applicant, it is the defendant in the main Suit. The plaintiff has filed a Suit for declaration and for mandatory injunction. The applicant / defendant is a registered Society and the records pertaining to the lease are not readily available with them. 3.Other side has not seriously objected.
4.Considering the above said reasons stated by the applicant in the affidavit, and also considering the facts and circumstances of the case, and considering the number of days delay, this application is allowed. The written statement filed by the applicant is taken on file.
