PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus forbearing the respondents 1 to 3 from opening the liquor shop (TASMAC Shop) in Survey No.532, at Thirumudivakkam, Krishna Nagar Ph-II, Kancheepuram District by considering the petitioner's representation dated 08.09.2025. ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.

2. This public interest litigation has been filed praying for a relief to restrain the respondents from opening Tasmac Shop in Survey No.532 at Thirumudivakkam, Krishna Nagar Phase-II, Kancheepuram District.

3. At the outset, learned counsel appearing for respondent Nos.2

and 3 would submit that, even before filing of this petition, the District Collector had passed an order granting permission on 02.09.2025. He further submits that a representation has also been submitted by the petitioner not to open any liquor shop.

4. Since an order has been passed on 02.09.2025, prior to the filing of this petition, the present writ petition is not maintainable without challenge to the order dated 02.09.2025.

5. The writ petition is dismissed with liberty to challenge the order dated 02.09.2025 passed by the District Collector. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
