3. Ms.Nazeera Banu learned representing counsel would submit that M/s.A.Saloomi, learned counsel takes notice for the second respondent/Insurance Company and he has raised serious objection in allowing this petition.

4. Accepting the averments made in the affidavit filed in support of this petition, this petition is ordered and the delay of 176 days is hereby condoned.
