O R D E R

The petition has been filed seeking a writ of Mandamus, directing the respondent police to evict the unlawful protestors from the premises of the writ petitioner and provide necessary and adequate police protection.

2. The case of the petitioner is that three faculty members viz., Dr.M,Vennila, Ms.V.Akila Devi and Dr.B.Sujatha deliberately refused to comply with the rules and regulations of the institution by not signing the attendance register twice daily, once for signing in and once for signing out. Therefore, the management withheld their career advancement and salary increments. Agitated by the same, the said teachers, who are respondents 4 to 6 indulged in a unlawful protest by remaining inside the campus. The petitioner had given a complaint to the respondent police. Since the respondents have not taken any action, the present writ petition has been 2/5

filed.

3. When the matter is taken up today, learned Additional Public Prosecutor would submit that coming to know of the filing of this case, the respondents 4 to 6 have left the premises and thereby the question of evicting them will not arise.

4. This court, on an earlier occasion, finding that the reason for the protest was on account of the dispute between the management and respondents 4, 5 and 6, had referred the matter for mediation to give a quietus to this issue. However, it is submitted by the parties that there is no settlement in the mediation.

5. Recording the same and finding that the writ petition has become infructuous, this writ petition stands closed. Consequently, connected miscellaneous petition also stands closed.
