Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the first respondent herein to dispose the petitioner's Appeal dated 17.03.2025 which is filed against the impugned proceedings passed by the third respondent vide D.R.No.2024/0153/06/001780TR dated 11.05.2024 relating to transfer of patta issued in favour of the petitioner and consequently, direct the first respondent to give instructions to the second respondent Tahsildar to issue online patta as per the proceedings passed by him.

ORDER
This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to dispose of the appeal filed by the petitioner on 17.03.2025 challenging the proceedings of the third respondent dated 11.05.2024 wherein the petitioner has sought for transfer of patta in her name.
2. Heard Mr.K.M.Malarmannan, learned counsel for petitioner and Mr.S.Rajesh, learned Government Advocate appearing for respondents.
3. The case of the petitioner is that the subject property was purchased through a sale deed dated 04.12.1997 registered as document No.11805 of 1997. The petitioner submitted an application before the second respondent seeking issuance of patta. The second respondent, through proceedings dated 25.06.2001, issued patta in favour of the petitioner. There was yet another property for which the petitioner has sought for patta and orders were passed on 17.08.2001 granting patta in 2/4
favour of the petitioner. The petitioner applied for building plan approval before the Commissioner of Tiruvannamalai Municipality. At that point of time, the petitioner realized that patta was issued to the petitioner by indicating a wrong extent i.e. instead of 2320 sq.ft., it was mentioned as 2099 sq.ft. In view of the same, the petitioner submitted an appeal before the first respondent on 17.03.2025. Since the same was not acted upon, the present writ petition has been filed.

Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the first respondent to act upon the appeal filed by the petitioner on 17.03.2025 after affording opportunity to interested parties, if any and pass final orders on its own merits and in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order. This writ petition is disposed of with the above direction. No costs.
