O R D E R

This writ petition has been filed challenging the circular dated 10.10.2025 on the file of the second respondent thereby issuing notification calling upon applications to fill up the post of University Officer(Special).

The petitioner had been appointed as Assistant Professor in Sheep Breeding Research Station, Nilgiris. He worked as Associate Professor. Thereafter, he was promoted as Professor and he was working s in the Department of Veterinary Parasitology, Madras Veterinary College, Chennai. Thereafter, he was appointed as Director of Centre for Animal Health Studies in the first respondent. Later, he was appointed as Dean in the Madras Veterinary College, Chennai on 16.12.2024. While being so, the petitioner was served with show cause notice alleging that during the post of Director under the control of the second respondent, nearly sum of Rs.2,19,84,968/- was misappropriated and financial loss is 2/5

directly attributable to the some of the officers including the petitioner. Though the petitioner submitted explanation for the show cause notice, the petitioner was suspended from service on 08.10.2025. Immediately after suspension, now notification has been issued to fill up the post of University Officer (Special), 2025 by the second respondent. 3.

The learned counsel for the petitioner would submit that the impugned notification cannot be sustained since immediately after two days from the date of suspension, the notification has been issued to the fill up the same post. The duration for submitting applications is 30 days. But as per the notification dated 10.10.2025, the duration has been reduced from 30 days to 15 days. Therefore, it is clear that the respondents are trying to throw out the petitioner as Dean and to appoint a person known to them.

Heard the learned counsel appearing on either side and perused all the materials placed before this court. 3/5

Admittedly, the petitioner has been suspended from service from 08.10.2025. Therefore, the petitioner has no locus to challenge the notification issued by the second respondent for filling up the post of University Officer (Special), 2025. If at all there is any aggrieved person over the notification, the said person can challenge the same in the manner known to law. As such, this writ petition is devoid of merits and the same is liable to be dismissed. However, the learned counsel for the petitioner submitted the petitioner was not paid arrears of salary. In view of the same, the respondents are directed to pay arrears of salary, if any, and also subsistence allowances to the petitioner in the manner known to law.

With the above direction, this writ petition stands dismissed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
