Prayer : Writ Petition filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus to forbear the respondents 1 to 3 from making any mutation of entries for the property situated in S.No.155/1, 156/1, 141/2C1, 158/2, 156/2 and 141/2B situated in Thottiyanur Village, Pillayappanpalayam Panchayat, Annur Taluk, Coimbatore District, until disposal of the proceedings in I.A.No.1 of 2023 in O.S.No.197 of 1988 on the file of the II Additional Sub Judge, Coimbatore and pass orders.

ORDER

This writ petition has been filed for issue of Writ of Mandamus, forbearing the respondent 1 to 3 from making any mutation in the revenue records pertaining to the subject property till the disposal of civil proceedings pending in I.A.No.1 of 2023 in O.S.No.197 of 1988 on the file of the II Additional Sub Judge, Coimbatore.

2. Heard Mr.Nandakumar of M/s.Eswar, Kumar and Rao Law Firm, learned counsel appearing for the petitioner and Mr.S.Rajesh, learned Government Advocate appearing for the respondents 1 to 3.

3. The case of the petitioner is that the proceedings are pending before the II Additional Sub Judge, Coimbatore in I.A.No.1 of 2023 in O.S.No.197 of 1988. While so, attempts are being made by the private respondents to add their names in the revenue records. This was based on the settlement deed which is said to have been executed by the sixth respondent in favour of the seventh respondent on 30.12.2023. In view of the same, the petitioner submitted objections to the second and third respondents on 03.08.2025, requesting them not to mutate the revenue records. Since the same was not considered, the present writ petition was filed.

Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the second and third respondents to deal with the objections submitted by the petitioner, as and when any application is submitted by the private respondents seeking for mutation of revenue records with respect to the subject property. 3/5

Thereafter, an opportunity shall be given to both sides and orders shall be passed on its own merits and in accordance with law.
