O R D E R

The petitioner, who was arrested and remanded to judicial custody on 31.07.2025, for the offences punishable under Sections 5(l), 5(j)(ii) r/w Section 6 of POCSO Act, 2012, under Sections 4(l), 5(l)(a), 5(l)(b), 5(l)(c) of Immoral Traffic (Prevention) Act & Section 98 of BNS, in Crime No.25 of 2025, on the file of the respondent Police, seeks bail.

2. The case of the prosecution is that the petitioner had committed forcible penetrative sexual assault against the victim minor girl. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and opposed the grant of 2/4

bail to the petitioner, submitting that there are totally 20 accused are involved in this case and the petitioner is arrayed as A3. He further submitted that the investigation is pending.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the facts and circumstances of the case, and taking into account that this Court, by order dated 03.10.2025, had already dismissed Crl.O.P.No.27185 of 2025 filed by the petitioner and that within ten days this second bail petition has been filed without any change in circumstances, this Court is not inclined to reconsider the same.
