ORDER

The petitioner, who was arrested and remanded to judicial custody on 06.10.2025, for the offences punishable under Sections 123 of BNS read with Section 24(1) of Cigarette and Other Tobacco Products Act in Crime No.623 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that the petitioner and other accused 3 and 4 belong to one family and they were running a betel shop at Kallakurichi bus stand; that they were found in possession of 240 grams of banned tobacco products, totally 12 packets (20 grams each) of Hans @ Gutka, Vimal Pan Masala and V1 Tobacco for the purpose of illegal sales. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 07.10.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that the petitioner is arrayed as A2 in this case and he has 10 previous cases; and that the investigation of this case is still pending.

Considering the facts, gravity of offence, the previous antecedents of the petitioner and taking note of the fact that the investigation of this case is still pending, this Court is not inclined to grant bail to the petitioner.
