ORDER

The petitioner, who was arrested and remanded to judicial custody on 06.09.2025, for the offences punishable under Sections 406, 417, 420 and 471 of IPC in Crime No.31 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner is a founder of the trust namely "Kamalam Foundation" and he along with other accused induced the defacto complainant to join the said foundation with the National Skill Development Corporation; that thereby received money to the tune of Rs.88,28,900/- on various dates through bank transactions and cash on the false assurance of returning the same with higher interest and subsequently, cheated the defacto complainant. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case; that the petitioner is ill health and he is in judicial custody since 06.09.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 2/4

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that the petitioner has cheated the defacto complainant to the tune of Rs.88,28,900/- and so far no money has been recovered and that the investigation of this case is pending. 5.

Considering the facts, huge amount involved in this case, so far no money has been recovered and taking note of the fact that the investigation of this case is pending, this Court is not inclined to grant bail to the petitioner.
