O R D E R
This writ petition has been filed for issue of a writ of mandamus directing the second respondent to dispose of the appeal dated 04.01.2025 within the time frame fixed by this Court.
2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.
3. The case of the petitioner is that the petitioner's father became the owner of the subject property by virtue of partition deed dated 20.06.1963. Thereafter, the property was settled in the name of the petitioner vide settlement deed dated 29.06.2006. The land was classified as "Natham". The petitioner approached the respondents 2 and 3 seeking for grant of patta in his name. The petitioner came to the knowledge that the patta stands in the name of one Muthusamy Gounder. Aggrieved by the same, the petitioner filed an appeal dated 04.01.2025 before the second respondent to rectify the said mistake. Since the same was not considered, the present writ petition has been filed before this Court.
4. Taking into consideration the facts and circumstances of the 2/4
case and considering the materials placed before this Court, there shall be a direction to the second respondent to deal with the appeal filed by the petitioner on 04.01.2025 on its own merits and in accordance with law and final orders shall be passed within a period of six weeks from the date of receipt of a copy of this order. If there are any interested parties, they shall also be put on notice before final orders are passed. The Writ Petition is disposed of with the above direction. There shall be no order as to costs.
