Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the respondents to grant patta for the lands measuring 3.50 acres bearing SF No.86, Pottiyam Village, Chinnasalem Taluk, Kallakurichi District by considering the petitioner's representation dated 08.09.2025 addressed to the 1st respondent (vide Grievance ID No.TN/ Rev/ KKI/ COLLMGDP/ 08 Sep 25/ 15042361/ 2025/ 08/ 09) in line with the order dated 06.11.2024 made in WP No.30143 of 2024 and its batch For Petitioner in all WP's : Mr.M.Adhishree For Respondents in all WP's : Mr.D.Ravichander, Special Government Pleader COMMON ORDER These writ petitions have been filed for direction to the respondents to consider the representations submitted by the petitioners 2/8
seeking patta for their respective lands.

The petitioners are in possession and enjoyment of the subject properties for several decades. But the subject lands are owned by the Forest Department and the petitioners are being Irulars, occupied the subject properties and they are enjoying the same. after introduction of the Act 26 of 1963 , GO.Ms.No.3551 (Revenue) Dated 31.12.1965 was issued and the said Act was made applicable to Jagirs (Inam Estates) belonging to the Jagirdars who ruled the Kalvarayan Hills. Section 10 of the Act provides for grant of land to ryots. The Government issued instruction for grant of patta. However, so far no survey has been undertaken for grant of patta.

On perusal of records, it is found that similarly placed persons filed batch of writ petitions before this Court in WP.Nos.30143 of 2024, etc. batch and by order dated 06.11.2024, the respective rejection 3/8
order was set aside and the respondents therein were directed to grant patta to that petitioners within a time frame. The said order was challenged by the respondents and they obtained interim order. That apart, on instruction, the learned Special Government Pleader appearing for the respondents submitted that the petitioners can very well enjoy their respective lands by taking produces from the subject lands, that too they cannot sell it directly and they have to supply all the produces from the subject lands to the Society concerned and in turn, the said Society will market the produces procured by the petitioners. However, the petitioners can enjoy the properties. Therefore, they are not entitled for patta since the subject lands are forest lands. 4.
In fact, the petitioners are seeking patta for their respective lands and the lands are nearly to an extent of 3 acres upto maximum of 3 1⁄2 acres. Therefore, the request of the petitioners seeking grant of patta for their respective lands cannot be considered. As such, all the writ 4/8
petitions are devoid of merits and the same are liable to be dismissed. 5.
Accordingly, all the writ petitions are dismissed. However, it is made clear that the petitioners can enjoy their respective lands and their possession cannot be disturbed by the respondents. There shall be no order as to costs.
