Writ Petition filed under Article 226 of the Constitution of India for a Wit of Mandamus, to direct the respondents to issue Vending Certificate to the petitioners to carry on their business on the pavement of eastern side Usman Road, from the junction of Venkateswara Street to till Hyperpothis, T.Nagar, Chennai - 600 017 by taking into consideration of their individual representation dated 06.10.2025 and their representation dated 07.10.2025.

ORDER

(made by R.SURESH KUMAR, J.) The prayer sought for herein is for a Writ of Mandamus to direct the respondents to issue Vending Certificate to the petitioners to carry on their business on the pavement of eastern side Usman Road, from the junction of Venkateswara Street to till Hyperpothis, T.Nagar, Chennai - 600 017 by taking into consideration of their individual representation dated 06.10.2025 and their representation dated 07.10.2025 through their sangam.

The petitioners joined together and filed the aforesaid writ petition with a prayer to consider the representation submitted by the petitioner dated 07.10.2025 seeking permission for them to run the hawkers business on the eastern side of Husman Road at T.Nagar from the junction of Venkateshwara Street to Hyperpothis.

3. Heard Mr.K.Lavan, learned counsel appearing for the petitioners and Mr.A.Arunbabu, learned Standing Counsel appearing for the 3/6

respondent Corporation.

4. The learned Standing Counsel appearing for the respondents Corporation would submit that, the stretch of Usman Road, where now the permission is sought for by the petitioners is not a vending zone and after construction of the over bridge, there is only a little space available for walkers, therefore, in that stretch if such kind of permission is granted to the hawkers to have the street vending business that would completely obstruct the ingress and egress of walkers along the side of the Usman road, therefore, it is thoroughly impossible to consider them for grant of such permission, but at the same time, the learned counsel would submit that the representation would be considered to explore the possibility to accommodate them in any other alternative field in that locality, where if the Town Vending Committee of the respondent Corporation decides to have the vending zone.

5. The said submission made by the learned Standing Counsel appearing for the respondents Corporation is taken on record.

6. In view of the same, there shall be a direction to the respondents to consider the representation of the petitioners dated 07.10.2025 only in 4/6

respect of any vending zone if it is so declared by the Vending Zone Committee and not in the non-vending zone, where these petitioners seek for such a permission.

With these directions, this writ petition is disposed of. No costs. Connected miscellaneous petition is closed.
