ORDER

This writ petition has been filed seeking a direction to the respondents to remove the name of K.Magi from the death certificate of Mrs.P.S.Komagan.

2. It is the grievance of the petitioner that her brother her younger brother, P.S.Komagan, who was unmarried, died on 15.02.2022. The petitioner performed all the last rites at her residence, and her husband arranged the funeral ceremonies at the burial ground on 16.02.2022. However, in the death certificate of her younger brother, P.S.Koman, the name of K.Magi has been erroneously shown as his wife. Hence, the petitioner lodged a complaint before the second respondent seeking removal of the said name. Since the first respondent did not take any steps, the petitioner approached the second respondent. However, the authorities refused to remove the name. Hence, the present writ petition has been filed.

3. I have heard the learned counsel on either side and perused the materials available on records carefully.

4. The status of the parties has been recorded based on the information furnished either by the hospital or the burial ground. As a matter of right, such an entry cannot be removed. If the petitioner claims that her brother died as bachelor, the same has to be established before the competent civil court, and not by way of a writ petition.
