ORDER

The Writ Petition has been filed for a direction, directing the respondent to forthwith withdraw the freezing instructions issued immediately and consequently direct the respondent to give Defreeze letter to the banks. 2.The petitioner is an accused in Crime No.96 of 2025, on the file of the respondent. Alleging that the petitioner involved in an offence under Section 420 of IPC, and misappropriated to the tune of of Rs.6,75,00,000/-. In order to investigate further, the accounts maintained by the petitioner viz. nearly 72 accounts were directed to be freeze down. As requested by the respondent, the bankers have frozen the accounts maintained by the petitioner and they did not permit the petitioner to operate the same. However, while pending investigation, the petitioner died and the respondent did not file any charge sheet as against other accused. . Therefore, the respondent had given instructions to the deceased petitioner's bankers to defreeze the accounts and permit to operate the same.

3.Now, the defacto complainant has filed an impleading petition in WPMP Crl.No.123 of 2026 to implead him as the 2nd respondent in the Writ Petition. Hence, WPMP Crl.No.123 of 2026 stands allowed. The defacto complainant has been impleaded as the 2nd respondent.
