2 to 4 to make corrections and issue separate patta in the name of the petitioner viz, Selvam S/o.Late Gopal with regard to his property in S.No.58/3D to an extent of 63 cents, situated at Mallikuttai Revenue Village, Omalur Taluk, Salem District based on the applications of the petitioner dated 18.08.2025 and 09.09.2025 respectively. For Petitioner : Mr.M.R.Jothimanian For Respondents : Mr.C.Jayaprakash Government Advocate [R1 to R4] *****
ORDER
This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents 2 to 4 to make corrections in the patta that has already been issued in the name of the petitioner with respect to the extent of the property based on the applications submitted by the petitioner on 18.08.2025 and 09.09.2025 respectively.
2. Heard Mr.M.R.Jothimanian, learned counsel for petitioner and Mr.C.Jayaprakash, learned Government Advocate appearing for respondents 1 to 4.
3. The case of the petitioner is that he is the owner of the subject property by virtue of a Will dated 14.08.2020 executed by his father. The petitioner's father died on 16.11.2020 and thereafter, the 2/4
petitioner became the absolute owner of the property. The grievance of the petitioner is that when the patta was inadvertently issued in the names of legal heirs of one Muthusamy viz., Govindhan and Selvam. According to the petitioner, these persons had nothing to do with the subject property as they had been allotted shares in Survey No.58/3F. Hence, in order to undertake the correction, the petitioner submitted online application on 09.09.2025 for sub-division and for issuance of patta. Since the same was not acted upon, the present writ petition has been filed before this Court.
4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the fourth respondent to act upon the petitioner's online application dated 09.09.2025 and deal with the same on its own merits and in accordance with law after affording opportunity to respondents 5 and 6 and final orders shall be passed within a period of eight (8) weeks from the date of receipt of a copy of this order.
