Prayer : Writ Petition filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the first respondent to expedite our revision / review petition dated 22.06.2025 and pass appropriate orders on merits and consequently direct the third respondent to demarcate our property in Arasur Village, Sulur Taluk, Coimbatore District comprised in Survey Nos.402/1F measuring total extent of 3 acres along with common pathway by conducting survey and pass orders.

ORDER

This writ petition has been filed for issue of Writ of Mandamus directing the first respondent to dispose of the revision petition dated 22.06.2025 and pass final orders within a time frame fixed by this Court.

2. Heard Mr.B.Manimaran, learned counsel appearing for the petitioners and Mr.C.Jayaprakash, learned Government Advocate appearing for the respondents 1 to 3.

3. The case of the petitioners is that the subject property was originally owned by their mother by virtue of registered sale deed dated 13.11.1974. During her lifetime, two registered gift deeds were issued in favour of the petitioners. The private respondents started claiming right over common cart track. Hence, the petitioners approached the third respondent seeking for survey of the property. When the third respondent attempted to survey the property, the same was obstructed by the private respondents. Hence, the survey could not be conducted. Thereafter, the petitioner filed an appeal before the second respondent. The second respondent by proceedings dated 30.05.2025, had directed the petitioners, either to approach the civil Court or to file a revision before the first respondent. The first petitioner thereafter made a representation to the first respondent on 22.06.2025, detailing the above facts. Since no action was taken by the first respondent, the present writ petition has been filed.

4. Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the first respondent to treat the representation dated 22.06.2025 as a revision 3/5

petition and deal with the same, on its own merits and in accordance with law, after affording opportunity to the respondents 4 to 8 and pass final orders within a period of eight weeks from the date of receipt of a copy of this order.
