ORDER

The petitioner, who was arrested and remanded to judicial custody on 07.10.2025, for the offences punishable under Sections 286 and 123 of BNS and Section 24(1) of Cigarette and Other Tobacco Products Act, 2003 in Crime No.519 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that based on a secret information, the respondent police went to the spot and found that the petitioner was in illegal possession of 208 kilograms of banned tobacco products in a car for the purpose of illegal sales. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 07.10.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that the petitioner was in illegal possession of 208 kilograms of prohibited tobacco products in order to sell the same to public at large to make an unlawful gain through illegal means; and that the investigation of this case is still pending.

Considering the facts, quantity of contraband involved in this case and taking note of the fact that the investigation of this case is still pending, this Court is not inclined to grant bail to the petitioner. 6.
