This Criminal Original Petition has been filed seeking to call for the entire records connected with the impugned FIR in Crime No.240 of 2024 pending investigation on the file of the 1st respondent police and quash the same.

The learned counsel for the petitioner would submit that the petitioner is arrayed as A-3 in Crime No.240 of 2024 registered for the offences under Sections 20(1) of the COTPA, 2003, Section 123 of the Bharatiya Nyaya Sanhita (BNS) 2023 and 4(1)(C) of the Tamil Nadu Prohibition (Amendment) Act, 2024. It is submitted by the petitioner that other than being the owner of the car bearing Reg.No.TN-07-CP-1218, he has nothing to do with the alleged offence. He would further submit that the petitioner is engaged in the vehicle hiring business and entered Car Lending Agreement dated 06.04.2023 with a company viz., Dribes Services and the said company has given the car for rent to the main accused who is alleged to have engaged in the transportation of the contraband. He would further reiterate that no material is made out to show that the petitioner has 2/5
any nexus with the accused Nos.1 and 2. He would further submit that the proceedings against the petitioner is nothing but an process of abuse of law.
3. Mr.R.Vinothraja, learned Government Advocate (Criminal Side) would submit that investigation is pending in the case.
4. Heard the submissions of both sides and perused the records.
5. Considering the submissions, this court directs the petitioner to appear before the respondent police along with a copy of the R.C.Book of the car and other related agreements and documents. The respondent police shall conduct an enquiry and if it is found that the petitioner has no nexus with the other accused, the petitioner shall be deleted from the array of the accused.
6. With the above directions, this Criminal Original Petition is disposed of . Consequently, connected miscellaneous petition is closed. 30.10.2025 nvsri 3/5
