ORDER
The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 303(2) & 326(a) of BNS Act, 2023, in Crime No.144 of 2025, on the file of the respondent Police, seek anticipatory bail.
2. This is the second anticipatory bail petition. The case of the prosecution is that the petitioners were illegally transported 10 buckets of river sand in a TATA Ace vehicle bearing registration No.TN-23-BB-2674 at Ponnai river, Kamarajapuram. Hence, the present case.
3. The learned counsel for the petitioners submitted that the petitioners have not committed any offense as alleged by the prosecution and have been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioners.
4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that, there are no previous cases pending against the petitioners. However, he 2/5
opposed to grant anticipatory bail to the petitioners.
5. Heard both sides and perused the materials available on record.
6. Since the petitioners involved in demolishing the ecology of the river and though the petitioners are not having any previous cases, this Court is not inclined to grant bail to the petitioners and there is no change in circumstances of the case 5.Accordingly, this Criminal Original Petition is dismissed. 23.10.2025 gbi To
