ORDER

The petitioner, who was arrested and remanded to judicial custody on 20.09.2025, for the alleged offence punishable under Sections 4(1)(a) and 4(1A) of TNP Act in Crime No.167 of 2025, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner is in possession of 30 bottles of 180 ml each consisting of "Diamond" and "Monitor" brandy of which two bottles were reportedly opened. It is further alleged that the petitioner was in possession of the said liquor without any valid bill or receipt and that the same was intended for personal gain by way of illegal sale akin to that of a TASMAC shop. The police are also stated to have taken two 180 ml bottles as samples, which they alleged emitted a poisonous odour. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and he is in judicial custody from 20.09.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner. 2/4

4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner is the sole accused and there are seven previous cases pending against the petitioner and he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions of the learned counsel on either side, there are seven previous cases are pending against the petitioner and this Court is not inclined to grant bail to the petitioner.
