ORDER

This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 09.04.2025, seeking bail in Crime No.218 of 2025 registered for the offences under Sections 8(c), 20(b) (ii) (C) of Narcotic Drugs & Psychotropic Substances Act, 1985. 2.The allegation against the petitioner is that the petitioner was found in possession of 140 kgs of Ganja and he was arrested after compliance of various provisions of NDPS Act and he is custody from 09.04.2025. 3.The learned counsel for the petitioner submitted that the petitioner alone has been cited as accused in this case. The quantity involved is 140 kgs of Ganja and single person could not transport or posses such huge quantity and he has been falsely implicated in this case. Hence, he prayed for grant of bail to the petitioner.

4.The learned Government Advocate (Crl.Side) for the respondent reported that on the secret information received from the informant, after

obtaining authorization, the police party reached the place of occurrence at Thendral Nagar Park, Anangaputhur and found that the petitioner was standing near six gunny bags. Immediately the police party approached him and after complying Section 50 of the NDPS Act, they have searched the six gunny bags and it revealed that the bags were containing Ganja and immediately those ganja has seized and also various phones used by the petitioner were seized and he was arrested and brought to the police and thereafter the samples were taken in the presence of Magistrate and the same was sent to the Chemical Analyst. The Chemical Analysis report was also received stating that the contraband seized from the petitioner is Ganja. He further submitted that the investigation is completed, final report was also filed and the same is taken on file in C.C.No.1120/2025.

5.Though it is stated by the learned counsel for the petitioner that the huge quantity could not have been handled by a single person, the police have concluded the investigation and stated that this petitioner alone brought for the purpose of selling the same to prospective buyers and since the quantity is also

commercial quantity, the rigor of Section 37 of the NDPS Act would arise in granting bail. The petitioner/accused has not satisfied the twin conditions required under Section 37 of the NDPS Act, hence this Court is not inclined to allow the present petition.
