ORDER

This Court had issued statutory notice in the Contempt Proceedings on 19.11.2025. The respondent M/s.R.Manoranjitham, had received the notice. Yet, she did not appear before this Court or before the First Assistant Registrar as required by law. Hence, this Court was constrained to issue bailable warrant for appearance of the petitioner. The case was listed today.

2.When the matter was taken up Mr.M.Suresh Kumar, the learned Additional Advocate General appearing on behalf of Dr.T.Seenivasan, has filed the affidavit of Ms.R.Manoranjitham. Ms.Manoranjitham also present in Court. In paragraph No.4 of the affidavit she has stated that the notice had been received by the office of the Assistant Director of Town Panchayat, Coimbatore, but had not been brought to her knowledge. In paragraph No.7, she has tendered an unconditional apology for not having appeared before the Court. The contemnor who is present in Court, stands by the affidavit. I am convinced with the reasons given in the affidavit. The bailable warrant issued is recalled.

3.The order passed by this Court in W.P.No.20722 of 2025 dated 11.06.2025 calling upon the contemnor to pass an order on the request of petitioner for grant of "No objection" certificate, pursuant to the communication issued by the District Collector, Coimbatore District. Alleging that this order had not been applied with, the present Contempt Petition has been filed. 4.Mr.M.Suresh Kumar has produced the proceedings whereby the application has been considered and order has also been passed. For ready reference, the same is scanned and extracted hereunder:-
