ORDER

This Contempt petition is filed alleging the violation of interim injunction granted by this Court in W.M.P.No.14446 of 2023 in W.P.No.14872 of 2023.

2. When the contempt petition is taken up for hearing, the learned Government Advocate appearing on behalf of the respondents had submitted that though the Director of Medical and Rural Health Services had sought for sanction of 14 driver posts, the Government did not sanction the same while issuing G.O.Ms.No.300 dated 01.07.2025.

3. The learned Government Advocate further submitted that since the Government did not sanction the aforesaid post, the respondents are not taking any steps to fill up the post of drivers as claimed by the petitioners in the present contempt petition thereby violating the interim order of this Court dated 01.06.2023.

4. The learned Government Advocate appearing on behalf of the respondents further submitted that an affidavit to the above effect deposed by the third respondent in the contempt petition is filed into this Court on 29.01.2026.

5. The affidavit filed by the third respondent is taken on record.

Since, the respondents, by the aforesaid affidavit, filed into this Court having categorically stated that the post of driver not being sanctioned by the Government and the said authorities are not taking any steps to undertake recruitment of the drivers and that the respondents have scrupulously complied with the direction of this Court under the interim order dated 01.06.2023, this Court is of the view that the aforesaid statement made by the third respondent by way of affidavit on record can be accepted by placing the said affidavit on the file of this Court. Since, the Writ petition is pending on the file of this Court, in the event of the respondents violating the undertaking as given to this Court under the affidavit of the third respondent dated 09.02.2026, it is open for the petitioner to initiate appropriate action at the relevant point of time. Accordingly, this Contempt case is closed. Consequently, connected Sub Application is closed.
